The first stage in making a claim it to ascertain whether or not you have a viable claim to make. Do I have a Claim?
If you are considering suing for professional negligence compensation, but you are unsure about the viability of your claim, it is important to consider the following:
Simply because a professional was wrong does not, of itself, mean you have a claim. A professional is not expected to be perfect but must perform to the standard of a reasonable competent professional. Even if the professional has fallen below the required standard you will only be entitled to compensation if you can show that it was the professional’s mistake which caused you to suffer significant financial loss.
For example, if a surveyor fails to notice some small defects in a property prior to purchase there may be no claim if it can be shown that the client would have gone ahead with the purchase at the same price even if the problems had been pointed out to him or her.
Another consideration when evaluating if you have a claim is when the actual negligence took place. A professional negligence claim must be made within 6 years of the date of the negligence having occurred. There are some exceptions to this (for example in cases of fraud) but these are limited.
